This is a courtesy translation. In case of any discrepancy, the Spanish version prevails, and Colombian law and courts apply.
The binding text is the Spanish-language version of these terms and conditions, published in the Spanish section of this site under the same name. If you need the authoritative wording, please refer to that version.
1. Site owner and purpose
This website is operated by [TODO(legal): legal name], a company incorporated in Colombia, with tax ID (NIT) [TODO(legal): NIT], domiciled at [TODO(legal): address], and reachable at hola@cautia.ai (hereinafter, “cautia”).
These terms govern solely access to and use of this website and the forms it contains. The provision of cautia services to insurance agencies and brokers is governed by the agreement signed in each case; in case of discrepancy between that agreement and these terms, the agreement prevails.
Access to the site is free of charge and requires no registration. Some sections may require you to submit data through a form, in which case the personal data processing policy also applies.
2. Acceptance
Use of this site implies full acceptance of these terms in the version published at the time of access. If you do not agree with them, you must not use the site.
As this is a site aimed at insurance professionals, you declare that you act on your own behalf or with sufficient authority to represent the entity you identify in the forms.
cautia may amend these terms at any time. The version in force is the one published on this page, with its update date visible [TODO(legal): confirm the effective date of this version].
3. Permitted use of the site
You may consult, download and reproduce the content of this site for your informational and professional use, provided that you cite the source and do not alter the content.
cautia may restrict access for any user who breaches the rules of use described below, without prior notice and without giving rise to any right to compensation.
In particular, the following is not permitted:
- Using the site for unlawful purposes or in bad faith.
- Attempting to access areas, accounts or systems that are not public.
- Introducing malicious code or any element that may damage the site or third-party systems.
- Extracting content automatically at a rate that affects the service.
- Impersonating third parties in the forms or supplying contact data that is not yours or that you are not authorised to use.
4. Intellectual property
The name “cautia”, its symbol, the design of the site, the texts, the graphics and the code belong to cautia or to those who have licensed them to it, and are protected by Colombian and international intellectual and industrial property rules.
Access to the site grants no licence over those elements beyond what is expressly permitted in the previous section.
The trademarks of insurance carriers and other companies shown on the site belong to their respective owners and are used nominatively, solely to identify document formats that the platform can process. Their presence implies no commercial relationship, sponsorship or endorsement.
5. Content, links and availability
cautia endeavours to keep the information published accurate and up to date, but does not warrant that it is free of errors or complete. The information on this site is commercial and informational in nature and does not constitute a binding offer.
The site may contain links to third-party pages. cautia does not control those sites and is not responsible for their content, policies or practices.
cautia makes reasonable efforts to keep the site available, but does not guarantee uninterrupted availability and may suspend it for maintenance or for reasons beyond its control.
6. Data messages and electronic communications
Under Colombian Law 527 of 1999, the data messages you exchange with cautia through this site or by email are fully valid and admissible as evidence, and are not denied legal effect merely because they are in electronic form.
Submitting a form constitutes an electronic communication addressed to cautia and is deemed received when it enters the destination information system.
You authorise cautia to reply through the same channel and to the contact details you have provided, in order to handle your request.
7. Use of artificial intelligence
cautia provides services that use artificial intelligence systems to read, classify, extract and organise information contained in documents. This fact is expressly disclosed on this site and in the personal data processing policy.
The outputs produced by those systems are subject to human review before being sent or used. cautia does not make automated decisions about people.
cautia is not an insurance intermediary and does not provide insurance advice. The documents produced by the platform — including comparison tables — are working tools of the contracting agency, which is the party that reviews, advises and answers to the financial consumer.
8. Limitation of liability
To the maximum extent permitted by Colombian law, cautia is not liable for indirect damages, loss of profit or loss of opportunity arising from the use of or the inability to use this site.
Nothing in these terms limits cautia liability for wilful misconduct or gross negligence, nor the obligations imposed on it by mandatory law.
Liabilities arising from the provision of the contracted services are governed exclusively by the corresponding services agreement.
9. Personal data protection
The processing of the personal data you provide through this site is governed by the personal data processing policy, which forms an integral part of these terms.
You may exercise your rights to know, update, rectify and delete your data, and to withdraw your authorisation, by writing to hola@cautia.ai, in accordance with the procedures and deadlines described in that policy.
10. Applicable law and dispute resolution
These terms are governed by the laws of the Republic of Colombia.
Any dispute related to the use of this site shall be submitted to the courts of the Republic of Colombia, without prejudice to the parties previously agreeing on an alternative dispute resolution mechanism.
[TODO(legal): decide whether arbitration or prior conciliation is agreed, and the city].
11. Contact
For any matter related to these terms you may write to hola@cautia.ai or to [TODO(legal): address for notices].
